Official Contest Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. CONTEST IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES AT LEAST 18 YEARS OLD OR AGE OF MAJORITY, WHO ARE ACTIVELY ENROLLED AS A FASHION MAJOR AT PARSONS SCHOOL OF DESIGN, LOCATED AT 66 5TH AVE, NEW YORK, NY 10011, AND ARE A SOPHOMORE, JUNIOR, OR SENIOR PRIOR TO THE START DATE OF THE CONTEST.

Contest Entities: CBS Studios, a division of CBS Studios Inc. ("CBS"), located at 1575 North Gower Street, 6th Floor, Los Angeles, CA 90028 and Parsons School of Design (“Parsons”), located at 66 5th Ave, New York, NY 10011. CBS and Parsons are collectively referred to herein as the “Contest Entities.”

Contest Description:
Each Participant (as defined below) entering the “The Search for Elsbeth’s Next Big Killer Look in Season 2: Contest with Parsons” contest (“Contest”) in connection with the CBS Show “Elsbeth” (the “Show”) will submit a minimum of one (1) and up to a maximum of three (3) design(s) based on the criteria outlined below (each an “Entry” and collectively, the “Entries”, as applicable) to: 2 West 13th Street, Office 307A, New York, NY 10011 during the Entry Period (as defined below). See the requirement/specification details in Section 6 below for the Entries.

1. Acceptance of Official Rules. By entering the Contest, you ("Participant") hereby accept and agree to these official rules ("Official Rules") of this Contest, and the decisions of CBS in connection with this Contest, whose decisions are final.

2. Eligibility. This Contest is offered and open to persons who are: (a) legal residents of the United States; (b) at least 18 years old or age of majority, (c) actively enrolled as a full-time or part-time fashion major at Parsons, and (d) a sophomore, junior or senior prior to the Promotion Period (defined below). Each Participant must remain an active student at Parsons throughout the Promotion Period (as defined below) in order to be eligible for the Contest Prizes (as defined below). Employees, independent contractors, and directors, and their immediate family members, of the Contest Entities and their parent, affiliated, and subsidiary companies, advertising and promotion agencies, and legal and financial advisors are not eligible to participate in this Contest. For purpose of the foregoing, "immediate family" means parents, spouses, children, siblings, or any members of the same households of such employees and directors.

3. Promotion Period. The Contest begins on October 17, 2024 and ends on December 12, 2024 ("Promotion Period"). The Promotion Period is divided into two (2) separate phases, the first phase being the Contest entry period (“Entry Period”) that shall commence on October 17, 2024 at 5:00:00 a.m. Eastern Time (“ET”) and end at 11:59:00 p.m. ET on December 1, 2024; and the second phase is the Contest judging period (“Judging Period”) that shall commence on or around December 1, 2024 and end on December 12, 2024. During the Judging Period, the judging panel, comprised of Dan Lawson, Robert & Michelle King, Jonathan Tolins, and Carrie Preston, (“Judges”) will commence review of all qualifying Entries received during the Entry Period. CBS reserves the right to substitute any Judge or Judges in its sole discretion. The Judges will then select the winning Entry(ies) based on the Judging Criteria (as defined below), which may be announced on CBS.com, CBS’s social media platforms and/or third party outlets.

4. How to Enter. During the Entry Period, Participant must create a minimum of one (1) and up to a maximum of three (3) design(s) and submit the Entries pursuant to the Entry Requirements (defined below) to: Parsons, 2 West 13th Street, Office 307A, New York, NY 10011. For clarity, each design counts as one (1) Entry, and each Participant may submit up to a maximum of three (3) Entries.

Participants, by submitting your Entries, you agree to assign the entire right, title and interest in and to the Entries to CBS and will waive any “moral rights” you may have in the Entries with no compensation due to you. You acknowledge that CBS may decline to select your Entries or exclude them from consideration for any reason, at any time, and in its sole discretion. With this assignment, you agree that CBS has the right to reproduce the Entries in full and/or edit and enhance any motion picture or other audiovisual work featuring the Entries at its sole discretion. CBS has the right to use the Entries as it sees fit in any manner, commercial or otherwise, including without limitation in the Show or any other program, and in connection with the distribution, exhibition and exploitation thereof in all media, now known or hereafter developed, in perpetuity throughout the universe, including without limitation in the advertising, marketing, publicity and promotion thereof. The Entries submitted will not be returned to Participants. CBS will not be responsible for any Entries that are lost, stolen, or misplaced.

5. Judging Criteria. During the Judging Period, all eligible Entries received will be judged by the Judges based on the following Judging Criteria: (a) appropriateness for the Elsbeth character and overall design of the show (50%); (b) originality, innovation, and creativity (30%); (c) tone and mood (10%); and (d) feasibility of actualizing the design (10%). The Judges will then choose one (1) first place winner ("First Place Winner"), one (1) second place winner (“Second Place Winner”), and one (1) third place winner (“Third Place Winner”, and together with the First Place Winner and Second Place Winner, the “Winners”). In the event a Participant submits more than one (1) Entry of the same design, only the first Entry received will be considered. All Entries must comply with these Official Rules. If the Entry does not comply with the Official Rules, CBS, at its sole discretion, may disqualify the Entry from the Contest.

Entries submitted after the Entry Period will not be entered into the Contest and will not be eligible for the Contest Prizes.

6. Entry Requirements. Entries will be submitted physically to the agreed-upon address noted above. Entries can be created using an iPad or sketched on paper with ink (printouts of originals are acceptable). The final submission(s) must include swatches, and each Entry must be accompanied by a 3 x 5 card that displays the name of the contest, “The Search for Elsbeth’s Next Big Killer Look in Season 2: Contest with Parsons”, as well as Participant’s: (a) full name, (b) address, (c) email address, (d) date of birth, (e) student ID number (only used to verify attendance at Parsons), and (f) phone number. Mail-in Entries must be postmarked by December 1, 2024 and received by December 4, 2024. Entries received after December 4, 2024 will not be considered in this Contest.

The guidelines for the Entries being submitted are as follows:
-Elsbeth Tascioni, the titular character of the Show, is a quirky lawyer from Chicago who has been transplanted to NYC to work with the NYPD. She marches to her own drum and is easily attracted to color, patterns, and sparkle. Keeping this in mind, Participant will be designing a winter look that captures Elsbeth’s unique style but is still appropriate for work.
-The look must showcase creativity and incorporate Elsbeth’s personality.
-Contestants must not recreate an already existing look from the Show.
-Each Entry must be Participant’s original creation, and AI and other persons’ designs may not be used.

Any Entry that does not meet the Entry criteria described herein may be disqualified in CBS’s sole discretion. The Entry must be in English and be suitable for presentation in a public forum, in the sole determination of CBS, and must not be disparaging, abusive, sexually explicit, sexually suggestive, offensive, illegal, libelous, defamatory, obscene, vulgar, offensive, indecent, in bad taste, reflect negatively on the Contest Entities, promote or incite violence, terrorism, or illegal acts, or be otherwise objectionable (all as determined by CBS in its sole discretion). Additionally, the Entry must not: (a) infringe any third party's rights, including, without limitation, copyright, trademark, right of publicity, or right of privacy and, must not in any way violate applicable laws and regulations; (b) contain libelous or otherwise defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group); and (c) contain any commercial content that promotes any product or service, or contain or reference any third party names, logos, service marks, trademarks, copyrights, trade names, trade dress, or other creative elements. The determination of whether an Entry violates any of the above prohibitions shall be in CBS’s sole discretion. If an Entry is deemed by CBS to violate any such prohibition(s), the Entry may in the sole discretion of CBS be disqualified and removed from the Contest, and the Participant shall not be eligible to participate in the Contest and/or win the Contest Prizes. CBS reserves the right to take down any Entry at any time during or after the Promotion Period and for any or no reason at all in CBS’s sole discretion.

7. Prizes. The Contest will award one (1) first place prize (“First Place Prize”) consisting of a check for Two Thousand Five Hundred Dollars ($2,500.00 USD) and the chance to work directly with fashion designer John Kristiansen along with Dan Lawson, the Show’s costume designer, to receive a personalized training experience whereby the First Place Winner will learn how to make a look from scratch from start to finish. Additionally, the First Place Winner will be able to attend an in-person fitting with Dan Lawson and Carrie Preston. The personalized training experience and in-person fitting will be on a date(s) to be determined by CBS. The First Place Winner’s design will also be revealed on-air during Season 2 of the Show in an episode to be determined at CBS’s sole discretion. The approximate retail value of the First Place Prize is Two Thousand Five Hundred Dollars ($2,500.00 USD). The Second Place Winner and Third Place Winner will each win a set visit with Dan Lawson (“Second and Third Place Prize”, and together with the First Place Prize, the “Contest Prizes”) on a date(s) to be determined by CBS. The Second and Third Place Prize does not have an approximate retail value.

The Contest Prizes are nontransferable. No assignment, transfer, or substitution of the Contest Prizes is permitted, except that CBS reserves the right to substitute the Contest Prizes with a prize(s) of comparable or greater value. The Contest Prizes are solely for personal use and may not be used in conjunction with any other promotion. All other costs and expenses not specified herein, if any, are the responsibility of the Winners. Details of the Contest Prizes are at the sole discretion of CBS.

8. Prize Taxes. All federal, state, local, income, and other tax liabilities arising from this Contest, including, without limitation, winning a Contest Prize, will be the sole responsibility of the respective Winners. If applicable, the Winners will be issued an IRS 1099 tax form for the value of the Contest Prizes.

9. Winner Notification. Participants will be notified at the end of the Promotion Period by email and/or by phone if they have been chosen as the Winners. In the event that there are, in the opinion of CBS, insufficient legitimate entries to judge, CBS reserves the right to select the Winners from among all Entries received. If the Winners cannot be reached after a reasonable effort has been made after three (3) business days from the first notification attempt, such persons may be disqualified at the sole discretion of CBS and alternate Winners may be selected in accordance with these Official Rules.

10. Affidavit of Eligibility/Liability Release and Publicity Release. In order to receive a Contest Prize, the Winners will each be required to complete, execute, and return an Affidavit of Eligibility/Liability Release and, where lawful, a Publicity Release, as well any and all other documents required by CBS (collectively, the "Release Forms") within three (3) days of notification of winning. Failure to properly execute and return the Release Forms in a timely manner may result in disqualification with alternate Winners selected in accordance with these Official Rules.

11. Publicity Release Terms. Except where prohibited by law, the Winners’ acceptance of their respective Contest Prizes constitutes permission for CBS to use the Winners’ names, videos, photographs, likenesses, statements, biographical information, voices, and addresses (city and state) worldwide and in all forms of media, in perpetuity, without further compensation in connection with the Contest and for the purposes of identifying the Winners.

12. Improper Conduct. CBS, in its sole discretion, may disqualify any Participant from participating in, or using any or all portions of, this Contest, and refuse to award the Contest Prizes if Participant engages in any conduct that CBS deems to be improper, unfair or otherwise adverse to the operation of the Contest, or detrimental to CBS or any other participant of the Contest. Such improper conduct includes, without limitation, (a) falsifying personal information, (b) violating any term or condition stated herein, (c) allowing others to use Participant’s personal information for the purpose of accumulating Entries, or (d) any other conduct that affects CBS adversely or reflects negatively on CBS, its goodwill, name, or reputation or causes duress, distress, or discomfort to CBS or anyone else, such as engaging in any behavior that is, or could be construed as, libelous, defamatory, indecent, vulgar or obscene, racially, culturally, or ethnically offensive, harmful, harassing, intimidating, threatening, hateful, objectionable, discriminatory, or abusive. Participant agrees that CBS may void any part of the Contest Prizes that Participant may have won and/or require the return of any part of the Contest Prizes that Participant may have won as a result of such improper conduct. Participant further acknowledges that any forfeiture of the Contest Prizes and/or return of any part of the Contest Prizes shall in no way prevent CBS from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct.

WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CBS RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Integrity of Contest. If, for any reason, the Contest is not capable of running as planned by reason of tampering, unauthorized intervention, fraud, technical failures, or any other causes which CBS, in its sole opinion, believes could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, CBS reserves the right at its sole discretion to cancel, terminate, modify, or suspend this Contest and select the Winners from entries received prior to the action taken or in such other manner as CBS may deem fair and appropriate.

14. Lost/Damaged Entries. The Contest Entities, and their parents, affiliated and subsidiary companies and advertising, marketing and promotion agencies, assume no liability and are not responsible for, and Participant hereby forever waives any rights to any claim in connection with, lost, late, incomplete, stolen, misdirected, illegible, damaged, or postage-due Entries; or for any unauthorized human intervention, fraud, technical failures, or the incorrect or inaccurate capture of information, or the failure to capture any such information. The Contest Entities, and their parents, affiliated and subsidiary companies, advertising, marketing and promotion agencies, are not responsible for any incorrect or inaccurate information, whether caused by registration information submitted by Participant or tampering, hacking, or by any of the equipment or programming associated with or utilized in this Contest, and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to the Contest.

16. Contest Errors. The Contest Entities, and their parents, affiliated and subsidiary companies and advertising, marketing and promotion agencies, assume no liability and are not responsible for, and Participant hereby forever waives any rights to any claim in connection with, errors and/or ambiguity: (a) in the Contest; (b) in any related advertising, marketing or promotions of this Contest; and/or (c) in these Official Rules. In the event of any ambiguity or error(s) in these Official Rules, CBS reserves the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s) without materially affecting the terms and conditions of the Contest.

17. Prizes and Winners. The Contest Entities, and their parents, affiliated and subsidiary companies, dealers and advertising, marketing and promotion agencies, assume no liability and are not responsible for, and Participant hereby forever waives any rights to any claim in connection with, the selection and announcement of the Winners, the distribution of the Contest Prizes, the acceptance/possession and/or use/misuse of any part of the Contest Prizes and/or any injury or damage to any Participant’s or third party's property related to or resulting from any part of the Contest Prizes or any part of this Contest.

18. Release and Indemnity. Each Participant in this Contest, including, without limitation, the Winners, hereby releases and agrees to hold harmless the Contest Entities and their parents, affiliates, subsidiaries, dealers, advertising, marketing and promotion agencies and their respective directors, officers, employees, representatives, agents and assigns from any and all liability for any injuries, loss or damage of any kind to any person and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use, or misuse of the Contest Prizes, participation in this Contest, and participation in any activity related to this Contest.

19. Limitation of Liability. IN NO EVENT WILL THE CONTEST ENTITIES, THEIR PARENTS, AFFILIATES, SUBSIDIARIES, DEALERS AND RELATED COMPANIES, THEIR ADVERTISING, MARKETING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS AND ASSIGNS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE CONTEST, INCLUDING WITHOUT LIMITATION PARTICIPANT’S ACCESS TO AND USE OF THE CONTEST OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE CONTEST. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO PARTICIPANT. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. FOR THE AVOIDANCE OF DOUBT, IN NO EVENT SHALL PARTICIPANT BE ENTITLED BY REASON OF ANY BREACH OR ALLEGED BREACH TO EQUITABLE OR INJUNCTIVE RELIEF, OR TO ENJOIN OR RESTRAIN, OR SEEK TO ENJOIN OR RESTRAIN, THE PRODUCTION, DISTRIBUTION, OR OTHER EXPLOITATION OF THE SHOW OR THE ADVERTISING, MARKETING, OR PROMOTION OF THE SHOW AND/OR THE CONTEST.

20. Disclaimer of Warranties. THE CONTEST & CONTEST PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

21. Identity Disputes. In the event of a dispute as to the identity of the Winners based on email addresses, the winning Entry will be declared made by the Authorized Account Holder of the email address submitted at time of entry. For purposes of these Official Rules, "Authorized Account Holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

22. Binding Arbitration. Participant waives all rights to trial in any action or proceeding instituted in connection with these Official Rules and/or this Contest. Any controversy or claim, arising out of, or relating to, these Official Rules and/or this Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of JAMS. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of California, in the City of Los Angeles and judgment on the arbitration award may be entered into any court having jurisdiction thereof.

23. Governing Law and Jurisdiction. This Contest is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Participant and CBS in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of New York, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 22 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of New York, in the City of New York.
